用人單位(甲方)：大酒店
職 工(乙方)：
根據國家《勞動法》的有關規定，經雙方友好平等協商自願簽定並共同遵守本合同。
一、乙方自願受聘於甲方籌備工作，乙方按甲方工作需要及領導安排認真做好本職工作。受聘期間甲方有權根據工作需要及乙方的工作能力和表現，調整乙方的工作，乙方必須服從安排。
二、合同期限：本合同自 年 月 日起生效。本合同有效期經甲乙雙方商定採取下列第 種形式。
本合同有效期自 年 月 日起，至年 月 日止。(乙方試用期可根據本人的工作能力及表現酌情縮短或延長)試用期的縮短及延長以綜合辦下文爲準。

四、勞動報酬

試用期滿乙方起點工資爲爲 元/月，甲方可按酒店工資制度調整乙方工資。
當乙方對甲方的經濟、效益等有突出貢獻時，甲方將給予相應的物質，精神獎勵。
五、試用其乙方其他各種福利待遇，按甲方依法制定的制度執行。
六、試用期滿甲方應及時對乙方進行考覈，評定。合格者按酒店崗位需要，並按酒店《員工守則》有關條款辦理聘用入職手續，不合格者，甲方有權延長試用期(延長期不超過-----月)或辭退。
七、本酒店的《員工手冊》和各項管理制度，應視爲本合同的組成條款，乙方必須認真學習，嚴格遵守，執行。甲方可根據實際情況依法進行修訂，解釋權屬甲方所有。
八、乙方在受聘內應按《員工手冊》中的勞動紀律，員工行爲規範，獎罰制度，員工培訓，安全生產，操作規程等要求，勤奮工作，盡職盡責，爲酒店的建設與發展做出貢獻，共創企業輝煌偉績。如嚴重違反，按有關條例處罰。
九、違約：在合同期內，任何一方如不遵守本合同條款，均屬違約，如乙方自動離崗，除扣發當月基本工資外違約方賠償對方違約金(以本人月基本工資數額爲罰金)。
十、本合同一式兩份，雙方各執一份，合同中未盡事宜，應經雙方友好協商解決，如有爭議也可通過當地勞動局仲裁部門依法解決。本合同自雙方簽字之日起生效。

乙方(受聘人)
根據國家有關法律法規，甲乙雙方按照自願、平等、協商一致的原則，簽訂本合同。
一、合同有效期：合同期限爲 年，自 年 月 日起至 年 月 日止，合同期滿聘用關係自然終止。聘用期間基本工資爲元/月;另外享受崗位津貼，聘用期間第一年崗位津貼爲 元/月，以後隨年度增加崗位津貼。績效工資按醫院效益酌情發放。
二、合同期滿前一個月，經雙方協商同意，可以續訂聘用合同。如任何一方不再續訂聘用合同的，應在合同期滿前一個月書面通知對方。
三、甲方聘用乙方在 崗位從事 工作。甲方有權根據工作需要以及乙方的專業知識、工作經驗及能力等綜合考慮安排和調整乙方的工作崗位。
四、甲方負責安排乙方的工作，並且爲其提供必要的、安全的工作條件及個人工作用品。
五、乙方接受聘用後，不得在本醫院以外的任何單位兼職或坐診。如有發現，輕者處罰，重者單位有權將其辭退，其在外所產生的任何糾紛導致的後果由其本人負責。
六、乙方享受聘用單位規定的工資待遇和相關福利，按雙方約定的薪酬待遇，甲方以人民幣現金支付。乙方應嚴格遵守醫院有關經營、人事、財務、薪酬等項工作的保密制度，如有違反，甲方有權解除此合同。
七、乙方在聘用期間，必須遵守甲方的一切規章制度及《員工手冊》，應服從領導，團結合作，盡職盡責做好本職工作。如有違反規定的，甲方有權調整其工作崗位或予以辭退，爲此乙方應表示無異議。
八、聘用期第月，甲方按國家規定爲乙方交納養老保險金和醫療保險金，聘用期間若乙方違反甲方規章制度被除名或乙方自行離職，要如數退還甲方爲乙方交納的養老保險金和醫療保險金。
九、有下列情形之一的，甲方可以解除聘用合同，但應提前10天以書面形式通知乙方(受聘人)
1、乙方患病或非工傷醫療期滿後不能從事原工作，也不願意從事甲方另行安排工作的。
2、乙方不能勝任工作，經過培訓或者調整工作崗位，仍不能勝任工作的。
3、聘用合同訂立時所依據的客觀條件發生重大變化，致使已簽訂的聘用合同無法履行，經當事人協商不能就變更聘用合同達成協議的。
十、乙方有下列情形之一的，甲方可以解除聘用合同：
1、乙方不履行聘用合同，或違反工作紀律和規章制度的。
2、嚴重失職，營私舞弊，給甲方利益造成損失的。
3、違法亂紀，被依法追究刑事責任的。
十一、乙方在接到解聘通知後，及時辦理有關手續，結清有關帳務，並將聘用期間掌握的甲方經營、財務、人事、印章、證照和相關物資全部移交甲方，不得扣留、損毀、滅失、轉移、否則應承擔相應的民事責任。
十二、乙方如辭聘應提前30天書面告知甲方，即辭即走者，當月工資和獎金不予支付。
十三、甲方未按合同約定支付工作報酬或者提供工作條件的，乙方有權要求解除聘用合同。但應提前30天以書面形式通知甲方。
十四、乙方因用人單位未按照聘用合同的約定支付工資報酬，而通知甲方解除聘用合同的，甲方應按合同的約定結算，在解除聘用合同的同時支付欠發的工資報酬。
十五、聘用合同簽訂後，雙方必須全面履行合同規定的義務，任何一方不得隨意變更合同。確需變更時，雙方協商同意一致，並按原簽訂程序變更合同，雙方未能達成協議的，原合同繼續有效。
十六、因不可抗力因素，致使本合同無法履行時，本合同自行終止，雙方互不追究責任。
十七、本合同一式兩份，甲乙雙方各持一份，經雙方簽字後生效。

13.裝運條款：
Shipping terms:
□FOB
賣方應在合同規定的裝運日期前30天，以電報/電傳/傳真通知買方合同號、品名、數量、金額、包裝件、毛重、尺碼及裝運港可裝日期，以便買方安排租船/訂艙。裝運船隻按期到達裝運港後，如賣方不能按時裝船，發生的空船費或滯期費由賣方負擔。在貨物越過船弦並脫離吊鉤以前一切費用和風險由賣方負擔。
The sellers shall,30 days before the shipment date specified in the contract advise the buyers by CABLE/TELE某/FA某 of the contract No.,commodity,quantity,amount,packages,gross weight,measurement,and the date of shipment in order that the buyers can charter a vessel/book shipping space,In the event of the sellers'failure to effect loading when the vessel arrives duly at the loading port,all expenses including dead freight and/or demurrage charges thus incurred shall be for seller's account.

14.裝運通知：

一俟裝載完畢，賣方應在 小時內電傳/傳真/電報買方合同編號、品名、已發運數量、發票總金額、毛重、船名/車/機號及啓程日期等。
The sellers shall immediately,upon the completion of the loading of the goods,advise buyers of the contract No.,names of commodity,loading quantity,invoice values,gross weight,names of vessels and shipment date by TL某/FA某/CABLE within hours.
15.質量保證：
Quality guarantee:
貨物品質規格必須符合本合同及質量保證書之規定，品質保證期爲貨到目的港 個月內。在保證期限內，因製造廠商在設計製造過程中的缺陷造成的貨物損害應由賣方負擔賠償。
The sellers shall guarantee that the commodity must be in conformity with the quality and specifications specified in this contract and Letter of Quality guarantee period shall be months after the arrival of the goods at the port of destination,and during the period the sellers shall be responsible for the damage due to the defects in designing and manufacturing of the manufacturer.
16.商品檢驗：賣方須在裝運前 日委託 檢驗機構對本合同之貨物進行檢驗並出具檢驗證書，貨到目的港後，由買方委託 檢驗機構進行復檢。
Goods inspection:The sellers shal have the goods inspected by Inspection Authority days before the shipment and issued the Inspection buyers shall have the goods reinspected by Inspection Authority after the goods arrival at the destination.
17.索賠：
Claims:
如經中國 檢驗機構複檢，發現貨物有損壞、殘缺或品名、規格、數量及質量與本合同及質量保證書之規定不符，買方可於貨到目的港後 天內憑上述檢驗機構出具的證明書向賣方要求索賠。如上述規定之索賠期與質量保證期不一致，在質量保證期限內買方仍可向賣方就質量保證條款之內容向賣方提出索賠。
The buyers shall lodge claims against the sellers based on the Inspection Certificate issued by China Inspection Authority days after the arrival of the goods at the destination,if the goods are found to be damaged,missing or the specifications,quantity,and quality not in conformity with those specified in this contract and Letter of Quality case the claim period above specified is not in conformity with the quality guarantee period,during the quality guarantee period,the buyers have rights to lodge claims against the sellers concerning the quality guarantee.
18.延期交貨違約金：
Late delivery and penalty
除雙方認可的不可抗力因素外，賣方遲於合同規定的期限交貨，如買方同意遲延交貨，賣方應同意對信用證有關條款進行修改和同意銀行在議付貨款時扣除本條規定的違約金。違約金總值不超過貨物總價值的5%，差率按7天0.5%計算，不滿7天仍按7天計算。在未採用信用證支付的情況下，賣方應將前述方法計算的違約金即付買方。
If the sellers fail to make delivery on time as stipulated in the contract,with exception of Force Majeure,the buyers shall agree to postpone the delivery on conditions that the sellers agree to amend the clauses of the L/C and pay a penalty which shall be deducted by the paying bank from the payment under negotiation,the penalty,however,shall not exceed 5% of the total value of the rate of penalty is charged at 0.5% for every seven days,if less than seven case,the payment is not made through L/C,the sellers shall pay the penalty counted as above to the buyers as soon as possible.
19.不可抗力：如發生不可抗力情況，賣方應及時以電報/傳真/電傳通知買方，並在14天內郵寄事故發生地政府或商會出具的證明事故的文件。
Force Majeure:The sellers shall advise the buyers by CABLE/FA某/TL某 in case of Force Majeure,and furnish the later within 14 days by registered airmail with a certificate issued by local government/Chamber of Commerce attesting such event or events.
20.爭議之解決方式：
Disputes settlement:
□任何因本合同而發生或與本合同有關的爭議，應提交中國國際經濟貿易仲裁委員會，按該會的仲裁規則進行仲裁。仲裁地點在中國。仲裁裁決是終局的，對雙方均有約束力。

21.法律適用：

本合同之簽訂地、或發生爭議時貨物所在地在中華人民共和國境內或被訴人爲中國法人的，適用中華人民共和國法律，除此規定外，適用《聯合國國際貨物銷售合同公約》。
It will be governed by the law of the People's Republic of China under the circumstances that the contract is signed or the goods while the disputes arising are in the people's Republic of China or the defendant is Chinese legal person,otherwise it is governed by United Nations Convention on Contract for the International Sale of Goods.
22.本合同使用的FOB、CFR、CIF、DDU術語系根據國際商會《Incoterms1990》。
